DC measure takes effect allowing benefits in more than one jurisdiction

A measure allowing those receiving workers compensation benefits from a state system to also seek benefits in the District of Columbia took effect Wednesday.

Bill 26-0061, enacted in August, repealed a prohibition on receiving benefits under the D.C. Code when comp benefits had already been awarded for the same injury or death. The bill also requires that the D.C. benefit award be reduced by the amount of compensation awarded in the other jurisdiction.

For example, a worker awarded $50,000 in D.C. and $20,000 in Maryland would receive $30,000 from the district.

The bill applies to any claim pending as of June 28, 2022, or filed after that.
