A bill was introduced in the West Virginia House of Representatives on Friday that would require a blood test for workers who sustained a traumatic injury to determine intoxication.
H.B. 4641 outlines requirements for testing and circumstances when a blood test may not be administered. The partisan bill would also allow for the denial of benefits upon refusal to submit to a blood test.
The bill was introduced and referred to the House Judiciary Committee, where it is pending.
