California committee approves experience rating on COVID claims

The Workers’ Compensation Insurance Rating Bureau of California will submit a regulatory filing that includes a provision to start including COVID-19 claims in employers’ experience rating later this year, a move that will affect an employer’s accident history risk and rates.
The WCIRB Governing Committee on Wednesday unanimously approved the filing and proposed revisions to the Unit Statistical Reporting Plan and Experience Rating Plan effective Sept. 1.
WCIRB attorney Kristen Marsh said the proposal would include COVID-19 claims with an accident date on or after that date in experience rating.
“Claims with an accident date from Dec. 1, 2019, to Aug. 31, 2022, will still be excluded,” she said. “It’s just the new claims with the accident date after Sept. 1, 2022, that would be added in.”
Ms. Marsh said the regulatory filing will be submitted to the California Insurance Department by the end of February.
