Doctor pleads guilty to writing medical-legal reports after suspension

A doctor agreed to plead guilty to fraud charges for writing medical-legal reports after he was suspended from California’s workers compensation system.

Dr. Kevin Do, of Pasadena, California, agreed to plead guilty to one count of conspiracy to commit mail fraud and one count of submitting a false tax return. Online records for the U.S. District Court for Central California indicate he is scheduled to enter the guilty plea at a hearing Jan. 3.

The doctor admits in a plea agreement with the federal court in Santa Ana, California, that he and an unidentified co-conspirator opened a business bank account for Liberty Medical Group in April 2016. While Dr. Do was working at Liberty, lawmakers enacted measures that required the Department of Workers’ Compensation to suspend all providers who have been convicted of fraud or who were kicked out of a program such as Medicare or Medicaid for fraud or abuse.

In August 2017, the division notified Dr. Do that he was facing suspension because of his 2003 conviction for defrauding Medi-Cal, the state’s Medicare program. The suspension was finalized and took effect in October 2018, but Dr. Do continued to perform similar actions for Liberty that he had done before his suspension, including compiling and editing medical-legal reports for Subsequent Injuries Benefits Trust Fund applicants, according to the plea agreement.
