New York considers new comp fraud assessment commission

New York lawmakers are considering two bills that would create a nine-member committee appointed by the governor to assess workers compensation fraud committed by those paying comp claims.
A.B. 8429, introduced Thursday, and S.B. 7950, introduced Wednesday, would give the commission the power to investigate and prosecute workers compensation fraud, including “willful” failure to secure payment of workers compensation and failure to “keep true and accurate records” as required by law.
The bill would also create a state fund to investigate fraud, with half of funds distributed to district attorney offices.
