NY bill would presume opioid death work-related

New York lawmakers are considering a workers compensation presumption bill that would make compensable the death of an injured worker who was determined to have died of an opioid overdose.
A.B. 4457, introduced Tuesday and referred to the Labor Committee, states the presumption would apply if the “injured worker was prescribed opioids as a result of such injured worker’s workplace injury.”
The presumption would not apply in cases of suicide, according to the bill.
