Outsourcing firm settles with EEOC over blind worker’s claim

The U.S. Equal Employment Opportunity Commission said Monday that outsourcing company The Results Cos. LLC had agreed to pay $250,000 to settle a disability discrimination suit involving a workplace accommodation for a blind customer service representative.

According to the complaint in Equal Employment Opportunity Commission v. The Results Companies LLC, filed in U.S. district court in Wichita Falls, Texas, the company fired the employee after failing to provide a suitable screen reader application.

The worker had 16 years of experience in call center-based customer service roles, the complaint said. After being hired by Fort Lauderdale, Florida-based The Results Cos., which does business as ResultsCX, the company, among other things, did not provide an up-to-date version of screen-reading software, and the technology staff assigned to install it were unfamiliar with the software, the complaint states.

The company asked the worker to step down and said it would rehire her after obtaining the newest version of the software, but it later terminated her.

In a statement, ResultsCX said it had not treated anyone unlawfully.

“The settlement was completed to end litigation without the admission of any wrongdoing.  The Results Companies LLC is an Equal Opportunity Employer, committed to having a diverse and inclusive workforce, and to advocating for the respect and dignity of all our employees,” the statement said.
